Promethais - Terms of Service

Welcome to Promethais! These Terms of Service ("Terms") govern your access to and use of the Promethais mobile application ("App"), owned and operated by Promethais.
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.
2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age to form a binding contract.
3. Account Creation
You may be required to create an account to use certain features of the App.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating an account.
4. User Conduct
You agree to use the App for lawful purposes only.
You are solely responsible for all content and activity that you submit, post, or otherwise make available through the App.
You agree not to engage in any of the following prohibited activities:
- Violating any local, state, national, or international law or regulation.
- Transmitting any harmful content, including viruses, malware, or other destructive code.
- Attempting to interfere with the proper functioning of the App.
- Impersonating any person or entity.
- Engaging in any other behavior that we, in our sole discretion, deem inappropriate.
5. Intellectual Property
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Promethais, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6. AI Interaction
The App allows you to interact with an AI companion.
The AI's responses are generated by artificial intelligence and should not be considered professional advice.
We are not responsible for any actions taken based on the AI's responses.
7. Subscription Fees
The App is offered on a monthly subscription basis.
By subscribing to the App, you agree to pay a recurring monthly subscription fee of $20.00.
You will be charged the subscription fee at the beginning of each billing cycle.
Subscription fees are non-refundable. You will not be eligible for a refund for any unused portion of a billing cycle.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
10. Termination
We may terminate your access to the App, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.
12. Dispute Resolution
Any dispute arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.
13. Entire Agreement
These Terms constitute the entire agreement between you and Promethais relating to your access to and use of the App.
14. Waiver & Severability
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
